SilverBAC (“SilverBAC”, “we”, “us”, or “our”) provides a digital platform that connects with approved BAC monitoring hardware and captures authenticated video evidence of each test. This privacy policy explains how we collect, use, disclose, and secure personal data belonging to registered users, program administrators, and support contacts (“Users”).

2. Data We Collect

Account & Identification

• Full name, email, phone number, and user credentials.
• Program enrollment details supplied by supervising organizations.

BAC Hardware & Session Data

• Breathalyzer serial numbers, firmware versions, calibration logs, and connection diagnostics.
• Timestamped BAC measurements, test results, and device error codes.

Video & Audio Evidence

• Video recordings and still frames captured during BAC tests to verify identity and compliance.
• Ambient audio captured simultaneously with recorded tests when your device’s microphone is enabled.

Location & Device Information

• Approximate or precise geolocation (if granted) to confirm testing location compliance.
• Device model, operating system, IP address, app logs, and crash diagnostics.

Support & Communications

• Support tickets, call history, and feedback submitted through in-app chat or email.
• Audit logs documenting administrative actions within SilverBAC.

Cookies & Analytics

• Session cookies and analytics identifiers to maintain secure sign-in and track feature usage trends.

3. How We Use Personal Data

• Authenticate Users and manage programs linked to supervising agencies or employers.
• Pair the SilverBAC mobile app with certified BAC hardware and confirm device readiness before each test.
• Capture and encrypt BAC readings together with recorded video evidence to create tamper-resistant compliance reports.
• Provide support, debugging, and calibration guidance when hardware connectivity fails.
• Generate insights for authorized program administrators, including missed tests and anomaly alerts.
• Monitor platform integrity, defend against fraud, and meet legal and regulatory obligations.
• Improve app performance, develop new safety features, and conduct internal analytics.

4. Legal Bases for Processing (EEA/UK Users)

• Performance of a contract to provide court-mandated or employer-sponsored monitoring services.
• Compliance with legal obligations relating to sobriety verification and incident reporting.
• Legitimate interests such as fraud prevention, product improvement, and ensuring hardware integrity.
• Consent when you opt in to optional features such as location tracking or marketing updates.

5. Sharing & Disclosure

• Approved program administrators, supervisors, and agencies with whom you maintain a compliance relationship.
• Hardware service providers that maintain or replace authorized breathalyzers under strict data-processing agreements.
• Secure cloud infrastructure, analytics vendors, and communications partners that operate on our behalf.
• Law enforcement or regulators when legally required or when you authorize the release of test evidence.
• Successors in the event of a merger, acquisition, or asset sale, subject to continued protection of personal data.

We do not sell personal data. All third parties must use personal data only for the contracted services and maintain equivalent safeguards.

6. Data Retention & Security

• BAC readings, metadata, and associated media are retained for the duration of your mandated program plus legally required retention periods.
• Video and audio files are encrypted at rest and in transit; access requires multi-factor authentication and logging.
• We perform regular security assessments, vulnerability testing, and breathalyzer firmware audits.
• When retention obligations end, we delete or irreversibly de-identify personal data following certified destruction protocols.

7. Your Rights & Choices

We may update this privacy policy to reflect product enhancements or regulatory changes. We will post the revised policy in the app and update the “Last updated” date. Substantive changes will be communicated through in-app notices or email.
